Divorce
- Legal Separation: a first step in the divorce process or a separate legal action.
- Collaborative Divorce Law: a relatively newer form of divorce focused on a mediation style in which both parties have their own attorney and both agree to resolve the issues (not go to court) with the assistance of financial and legal counselors.
- Contested Divorce: from a court's view, all divorces are contested matters initially; contested divorce usually means litigated divorces in which the parties have disputes over children, property (including money), or support.
- Divorce effects insurance, social security benefits, and deferred income plans including Wisconsin Retirement System accounts are affected by divorce.
- Marital property includes property acquired during (and sometimes before) the marriage. A marital property settlement or agreement must be formed for all divorces.
- Mediation can be used to resolve issues between divorcing spouses. Court ordered mediation is mandated by a judge and paid for by the parties to the divorce.
- Uncontested divorce: the parties have resolved all of the issues pertinent to divorce and the marital property agreement that the court requires; the attorneys prepare their stipulation.
