Wisconsin Alimony

Previously, Wisconsin law provided for alimony - money paid by one spouse to another spouse, regardless of whether the couple had children. Today, alimony is called maintenance. Wisconsin changed the term from alimony to maintenance about 15 years ago.

Length of Maintenance Payments

A court can order maintenance for a temporary period of time or permanently. The Court may take many factors into consideration. Some of those factors include the length of the marriage, the earning capacity of the parties, or the assets of the parties.

Determination For Maintenance

The process by which a determination is made by a Court before maintenance is ordered can be a very fact-intensive review of all of the circumstances surrounding the marital relationship of the parties. A court can order maintenance to be paid even if there were no children born to the spouses; however, the parties must have been married. Wisconsin does not recognize common law marriages.
